CAN I CLAIM COMPENSATION WHEN MY NEIGHBOUR’S DOG BITES MY CHILD

The question is often asked, when is an owner of an animal liable where the animal for example a dog, causes damage to another person.

The owner of a dog would be liable if the dog bites a person and the dog acts contrary to its nature. This means that the dog must have acted, objectively seen, contrary to what may be expected of a decent and well mannered animal of its kind.

It cannot be said that the dog acted contrary to its nature if there is some external stimuli.
